    PRIVACY POLICY – PERSONAL DATA PROCESSING INFORMATION
    pursuant to Article 13 of Regulation (EU) 2016/679 of the European Parliament and Council, dated April 27, 2016 (GDPR)

    The GDPR (Regulation EU 2016/679) governs the protection of individuals and other subjects with regard to the processing of personal data.
    According to the aforementioned regulation, all data processing shall be based on principles of fairness, lawfulness, and transparency, while also safeguarding your privacy and your rights.

    In compliance with the GDPR, we provide you with the following information:

    The Data Controller is:
    ARKdeko’ Design by Angelica Cataldo
    Via del Pero 14-16-18, 86039 Termoli (CB), Italy
    VAT No. IT01680640701

  • Place of Personal Data Processing

    The processing activities related to the web services of this site take place at the headquarters of ARKdeko’ Design by Angelica Cataldo. These processing activities are also carried out by the technical staff appointed for data handling, or by authorized personnel involved in occasional maintenance operations.

  • Purpose of Personal Data Processing

    The personal data provided by users who access the website and send an email message to the data controller (including through the contact form available in the designated section of the website) will be used solely to perform the requested service. The optional, explicit, and voluntary sending of emails to the addresses indicated on the website inherently involves the subsequent acquisition of the sender’s email address—necessary for responding to requests—as well as any other personal data included in the message.

    The data controller processes personal data only to the extent strictly necessary for the performance of the requested service, excluding any processing where the purposes can be achieved using anonymous data or methods that identify the user only if needed.

    We kindly ask users not to include names or personal data of third parties unless strictly necessary, and to refrain from submitting any sensitive or special category data (as defined under Article 9 of the GDPR).

    If a user includes personal or contact information of any third party in their request, they acknowledge that such action constitutes personal data processing, for which the user acts as an independent data controller—assuming all responsibilities and obligations under the GDPR.

    In this regard, the user guarantees that any third-party data submitted has been collected in full compliance with the Regulation, including documented consent (in writing if applicable) from the third party. The user indemnifies the data controller against any claim, complaint, or demand for damages resulting from unlawful processing of such data.

    The lawfulness of processing is based on the legitimate interest of the data controller to respond to user inquiries and to detect potential cybercrimes affecting the site.

    User data may also be processed for the conclusion of a sales contract. The user is aware that the email address provided may be used to send direct marketing communications related to ARKdeko' Design’s products and services.

    Additionally, personal data may be used to register and access the Reserved Area, provided the appropriate request form is completed on the website.

    With prior explicit and written consent (also digitally provided), personal data (name, surname, and email address) may be used to send commercial communications for direct marketing of ARKdeko' Design’s products and services, including subscription to the Newsletter section.

  • Types of Personal Data Processed

    The IT systems and software procedures used to operate this website acquire, during their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols (so-called browsing data). These types of information are not collected to be associated with identified individuals but, by their very nature, could—through processing and association with data held by third parties—allow users to be identified.

    This category of data includes IP addresses or domain names of the computers used by users connecting to the site, URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the server response status (success, error, etc.), and other parameters related to the user's operating system and IT environment.

    These data are used solely for the purpose of obtaining anonymous statistical information on the use of the site and to ensure its proper functioning. The data may also be used to ascertain responsibility in the event of potential cybercrimes committed against the site.

  • Rights in Relation to the Data Controller

    Users have the right to:

    • Withdraw consent to the processing of their personal data at any time, without affecting the lawfulness of processing based on consent before its withdrawal;

    • Receive their personal data, provided to a data controller, in a structured, commonly used, and machine-readable format, and transmit such data to another data controller without hindrance from the original controller;

    • Access their personal data held by the data controller;

    • Request the rectification of their personal data, provided it does not conflict with applicable data retention regulations;

    • Request the deletion of their personal data, provided it does not conflict with applicable data retention regulations;

    • Request the restriction of the processing of their personal data;

    • Object at any time, for reasons related to their particular situation, to the processing of their personal data under Article 6(1), letters (e) or (f) of the GDPR, including profiling based on those provisions;

    • Object at any time to the processing of their personal data for direct marketing purposes, including profiling to the extent that it is related to such marketing;

    • Not be subject to a decision based solely on automated processing, including profiling, that produces legal effects concerning them or similarly significantly affects them.

    These rights may be exercised by sending a request to the data controller via hand delivery, standard mail, registered mail, fax, or email at the following address:
    📧 This email address is being protected from spambots. You need JavaScript enabled to view it.

    To facilitate the exercise of these rights, the Italian Data Protection Authority provides a dedicated form available on its website: www.garanteprivacy.it

    The user is also informed of their right to file a complaint with a supervisory authority, in particular with the Italian Data Protection Authority (Garante per la protezione dei dati personali).
